What are the requirements for an RIR?

The RIR application requires specific requirements from each party which is listed below:

Employer Requirements
The employer who files the application on behalf of the alien must attest to the following:

  • The position is a bonafide full time permanent job offer located within the U.S.;
  • The job offer meets prevailing U.S. wage requirements;
  • The job offer's working conditions and environment does not adversely affect U.S. workers; and
  • There is no qualified U.S. worker available to accept the job offer.

Prospective Employee Requirements
The prospective employee who benefits from the application must attest to the following:

  • He/she meets the educational and work requirements of the employment position at the time the RIR is filed.
  • He/she maintains valid U.S. status if living within the U.S. What factors may affect an RIR?
