If the marriage becomes nonviablewhile in the process of an I-485 Adjustment of Status after the immigration petition was approved, the petition of adjustment of status cannot be denied provided that the marriage was entered into in good faith. Marriages are considered nonviable if the couple separates or no longer share a household. However, if the marriage is legally terminated, the alien's petition could be denied.
