To confer and enjoy immigration benefits, bothparties of a valid marriage shall keep the marriage in existence. Existence of a marriage does not require that the couple live together or share a household, but the couple must not have legally terminated the marriage.
However, in the states where a legal separation automatically results in a divorce, it is likely that the marriage no longer exists.
