Attorney Comments: Attorney Joe Jian Zhou filed PERM EB-2 case in July 2012, and it was approved in October, 2012.  Premium Processing I-140 was filed in October 2012 and was approved within a week.  The principal was born in China with EB-2 visa retrogression more than 4 years.  However, the spouse was born in a country without EB-2 visa retrogression for the month of November 2012.  Based on a cross-chargeability rule, attorney Joe requested that the visa number to be charged to the country of the spouse (derivative I-485 applicant) and filed I-485 for the family in early November, 2012.  The whole family’s I-485s were approved in late January 2013.  The client was approaching to his 6th years of H-1B limitation when PERM was started.  The position is a financial analyst.
