Case Background and Comments

This client is a postdoc in biomedical field. He signed up for both an NIW and EB-1A, and Jianhua helped filed both petitions in September, 2011. Client’s employer was slow to extend his H1B and he may have to stop working after H1B expiration date if without EAD. So I-485 was filed while EB1A was pending in order to continue working after H1B expiration date. In April of 2012, five days after NIW approval, the EB1A got RFE which is tough to counter. It was issued by notorious officer No. XXX. The EB1A was finally successfully approved.
