Case background: Jianhua helped the Client to file a B2 visa application right after he was laid off.  His B2 status will only be valid for 6 months. 10 days before his B2 status’ expiration date, the Client found a job and his employer was willing to sponsor his H1B application.

The H1B application was received by the USCIS on the last day that the client’s B2 status was valid. However, the USCIS issued a RFE (Request for Evidence) for this H1B application because they doubted the validity of the Employer-Employee relationship. The RFE was tough to counter, but the H1B was finally successfully approved.
