Background:

A Medical Doctor from a Mideast country.  Facing the expiration of 6 years of H-1B, the client filed EB-1A (through another attorney) and filed I-485 (with EAD card) for the purpose of getting temporary employment authorization.  However, client understood the small chance of approval of EB-1A or NIW and retained Zhang & Associates, PC for PERM.  Attorney Joe Jian Zhou filed PERM and received approval within 3 months and received I-140 approval within 2 weeks through the premium processing.   The Client has expired H-1B 6 –year period for more than 180 days and is not eligible for regular I-485 adjustment filing.  But the Client has used advance parole for travelling and has been in parolee status.  Attorney Joe researched the statute and found a rarely used rule that an parolee is eligible for filing new I-485 adjustment of status.  So, Attorney Joe filed a new set of I-485 based on approved on PERM I-140 in August 2011.  In January 2012, client’s EB-1A and the associated I-485 were both denied as expected.  But in two days later, the client received approval of I-485 and green card based on Attorney Joe filed second I-485 case. “
