Mr. Wen

Mr. Wen was an advanced degree professional in cytotechnology by virtue of his master's degree in Clinical Laboratory from a prominent research university. He is currently hired by a private research laboratory as a cytotechnologist.

Mr. Wen retained Zhang & Associates, P.C. for his NIW petition. At the very beginning, our experienced attorneys noticed how tough his case would be because he had not even a singled article published on an academic journal. Therefore, our legal team designed a unique approach.

First, our elite legal team emphasized to the immigration officer how significant his research field could impact the academic community.  We claimed that Mr. Wen was a cytotechnologist working in the fields of cytopathology, oncogenic viruses, and the diagnosis and management of cancer. We stressed that his research focused on rapid and accurate diagnosis of cancer, particularly Malignant Melanoma. Although he did not author any articles, his master’s thesis and other research results had been presented at a major scientific conference in her field.

We also emphasized that Mr. Wen had extensive experience and training in the his field. We provided a lot of documentation to show to the officer that Mr. Wen had various professional certifications and had been through various professional trainings. Furthermore, we submitted 5 glowing and strong recommendation letters testifying that Mr. Wen’s research would impact his field and greatly improve the national healthcare.

Thanks to our convincing arguments and unique approach, Mr. Wen’s petition was submitted on December 22, 2005 and approved on May 23, 2005.

Our attorneys first carefully reviewed her academic record and achievements. We highlighted the following facts: in his early career prior to his arrival in U.S., he worked on structural characterization of nanostructured materials by means of X-ray diffraction techniques, which was funded by the National Science Foundation; due to his exciting research performance, he was granted a research fellowship to continue his research on nanostructures in a top European research institute.

We further demonstrated to the immigration officer that his research had resulted in numerous published articles in highly ranked journals such as Applied Physics Letters, Journal of Applied Physics; and his work had been cited more than 150 times, including at least 36 "non-self-citation" articles and 19 articles citing Dr. Sidorov’s first-authored work.

To prove that his research is national in scope, we stated to the officer that as a strong sign of the national interest of his work that his current research is funded by the U.S. Department of Energy (DOE), and can be applicable to the extremely important nano-industry in the U.S.

Due to our persuasive argument and thorough documentation, Dr. Sidorov’s petition was approved in May, 2005.

We showed to the officer that Dr. Ma participated in a high-profile U.S.-China international collaborative intervention study on the prevention of neural tube defects with periconceptional folic acid supplementation. This was considered a landmark study in the field of preventative medicine and epidemiology. The results from this trial ultimately led to a change in the public health policy of folate fortification and impacted the health policy of many nations, including the U.S. in its adoption of folate fortification.

To emphasize the significance and impact of his work, we demonstrated to the officer that Dr. Ma’s research was concentrated on chronic diseases that are becoming increasingly prevalent in U.S. We also showed to the officer that Dr. Ma was actively involved in genetic projects studying the genetic causes of diabetes in American Women with different ethnic groups.
