CVIS, CMGT SUBJECT: New Nonimmigrant T Visa Category 1. The Trafficking
and Violence Protection Act of 2000 (TVPA) created a new nonimmigrant visa category
(T) to protect people who are victims of human trafficking. It is specifically
designed for human trafficking victims who cooperate with law enforcement in the
investigation or prosecution of acts of trafficking in persons. The T visa category
has been implemented and is available to certain victims of severe forms of trafficking
in persons. 2. 9 FAM 41.84 provides guidance
and information on the new T visa (Note: The guidance and information is
in PDF format, if you have no Acrobat Reader to read this document in PDF format,
please click here
to download a free copy of Acrobat Reader from http://www.adobe.com.--ZBG)
The revised notes are now available on the Department's Internet (www.foia.state.gov/fam)
and Intranet (http://10.4.64.84/fam/fam.html) sites, and are effective immediately. 3.
Some important points to note regarding the T visa: -- USCIS adjudicates all
applications for T visa status. -- Posts must not accept an application
for a nonimmigrant visa in the T category unless it has received Department notification
that the USCIS has approved that alien for T status. -- Kentucky Consular
Center (KCC) will notify post via electronic mail of all approved T visa applications. 4.
If posts are unable to access the online versions of the FAM and would like an
e-mailed copy of the updated notes, or if they have any questions about the notes,
they should contact CA/VO/F/P. 5. Minimize considered. POWELL (06/03/2002) For
