DOJ Proposes Rule Governing Foreign Student Reporting

The Justice Department has issued a proposed rule governing the retention and reporting of information regarding F, J, and M nonimmigrants. Among other things, the rule would implement usage of the Student and Exchange Visitor Information System (SEVIS).

This rule proposes to amend the Immigration and Naturalization Service (Service) regulations governing the retention and reporting of information regarding F, J, and M nonimmigrants. This rule will implement the Student and Exchange Visitor Information System (SEVIS), and establish a process for electronic reporting by designated school officials (DSO) of information required to be reported to the Service. This is necessary to improve and streamline the reporting and record keeping of F, J, and M nonimmigrants. This rule also proposes to amend the existing regulations relating to F and M students to improve accountability and to implement reasonable and clear standards governing the maintenance, extension and reinstatement of student
status.

The rule is published in the Federal Register on May 16, 2002. Interested persons are invited to submit written comments on the proposed rule within 60 days from the date of publication in Federal Register, that is, on or before June 17, 2002.
