Attorney Jian Joe Zhou Comments: Client received a green card based on an employer sponsored PERM case. The offered occupation in PERM and I-140 is a Senior Accountant. Client asked whether he could change the job title from senior accountant to manager as the company would like to promote him. For a PERM based green card case, the beneficiary alien is required to take the offered occupation in PERM application when the green card is approved, and is required to work at the occupation for a reasonable period of time to fulfill the good faith permanent job offer claimed in the PERM and I-140. Therefore, at the time of green card approval, the alien worker should start working (or continue to work) at the occupation offered in the PERM application. Change of the job title for business reason, if the duties are essentially not changed and kept the same as PERM occupation, is fine so long the employer carefully document the duties for the job under the new title. The nature of the occupation counts, not the title alone. But in practice, if possible, I always advise clients maintain the same job title as PERM occupation for a reasonable period of time after green card is approved.
