Attorney Jian Joe Zhou Comments: Client received employment based (PERM, I-140,  I-485) green card by carrying over an earlier priority date from an approved  I-140 from a former employer.  When an alien worker  received I-140 approval, the priority date confirmed in the I-140 approval notice can be carried over in to any future employment based EB-1, EB-2 and EB-3 categories. This offers a huge advantage for the alien workers whose countries of birth have per country immigration visa retrogression.  By carrying over the earlier priority date, an alien worker can receive immigration visa based on the earlier priority date.
