Attorney Jian Joe Zhou Comments: I-485 adjustment of status interview for employment based applicants started in 2017 and is now required for every principal and derivative applicant. The I-485 interviews sometime can be very tough as the USCIS officers check very details of all and every aspects related to the eligibility for adjustment. Issues that are often challenged include but not limited to unauthorized employment during F-1 or H-1B, communist party membership, public assistance/public charge, criminal charge/arrest, out of status, etc. It becomes critical that an applicant should go through in details of all issues with his or her attorney before interview.
