Comments from Attorney Jian Joe Zhou:
The unique part of the case is that the PERM position allows the employee to work from home anywhere in the US. The attorney advised the employer to advertise in multiple locations to support the claim. DOL first denied the case based on the work at home language, but approved the case after attorney filed reconsideration request with strong logic arguments. Then, I-140 and I-485 approved within 6 months after PERM was approved. Working at home or remote location is possible for a PERM position so long it is well designed and properly prepared.
