"Attorney Jian Joe Zhou’s note:  The beneficiary was about to reach five years anniversary of H-1B when the employer retained our firm for PERM based EB-2 petition.  PERM was filed before the five years anniversary.  The PERM was audited but the beneficiary was able to extend H-1B based on the AC21 Act of the pending PERM filing.  PERM petition was approved after audit and EB-2 I-140 was approved within a couple of weeks later by premium processing.  I-485 was approved within several months after filing.  The beneficiary was not subject to EB-2 visa retrogression."
