Attorney Jian Joe Zhou’s Comments: The H-1B case was approved after RFE procedure.  USCIS is getting tougher on approval of H-1B petitions, especially for smaller or new start up business.  Very often, USCIS issues Request for Additional Evidence (RFE) notices challenging on specialty occupation, right to control, and business existence issues.  With carefully and strategically preparation, it is still possible to achieve approval after RFE.  For the current case, a growing small business filed three H-1B petitions (company size around 10 employees) for two accountants and one market research analysts.  Two cases received RFE but both cases were approved after RFE.
