The U.S Department of State (DoS) has recently released its current visa bulletin for January 2022. The EB-1 cutoff dates for petitioners from all countries are still current. For the EB-2 category, all countries except for China and India remain current. China has progressed to January 22, 2019 while India has moved to July 8, 2012.

Final action dates for employment-based preference petitions:

• For EB-1:  All countries are current for the final action dates.
• For EB-2: the cut-off date for nationals born in mainland China moved to January 22, 2019. The cut-off date for Indian nationals has progressed to July 8, 2012. The cut-off dates for petitioners from all other countries remains current.
• For EB-3 – Professional and Skilled Workers: EB-3 cutoff date for China has stagnated at March 22, 2018.  The final action date for India has similarly stayed the same at January 15, 2012. The cut-off date for the remaining countries are now current.
• For EB-5 – Non-regional Center:  the final action date is current for all countries.

Filing dates for employment-based preference petitions:

• For EB-1: Filing dates are now current for all countries.
• For EB-2: The cut-off date for Chinese petitions remained at April 1, 2019, while the date for Indian nationals has also stayed at July 8, 2013. Petitioners from all other countries remain current.
• For EB-3: In the EB-3 category, mainland Chinese petitioners’ cutoff date has remained at April 1, 2018, while the date for Indian petitioners has also not moved at January 22, 2012. The cut-off date for petitioners from the remaining countries are current.
• For EB-5– Non-regional Center:  the final action date is current for all countries.

For Employment-Based Preference Filings:

For all employment-based preference categories, you must use the Filing Dates chart in the Department of State Visa Bulletin for January 2022.
