International Entrepreneur Parole Program Reinstated

On May 10th, 2021, USCIS announced that the International Entrepreneur Parole Program will continue in accordance with the Biden Administration’s executive order to promote access to the legal immigration system. A 2018 proposed rule to remove the program has been withdrawn by the Department of Homeland Security.

The International Entrepreneur Program allows for entrepreneurs to apply for parole in the United States. “Parole may be granted to up to three entrepreneurs per start-up entity, as well as their spouses and children. Entrepreneurs granted parole are eligible to work only for their start-up business. Their spouses may apply for employment authorization in the United States.”

To apply for this program, the entrepreneur must demonstrate that they own a substantial ownership interest in the start-up business created in the past 5 years that have had substantial growth and job creation. Furthermore, the entrepreneur must play a central and active role in the business. Lastly, the entrepreneur must show that the have provided a significant public benefit to the U.S in their role in the business.
