Trump-Era Public Charge Rule No Longer Enforced
On March 9th, 2021, the Biden Administration announced that the public charge rule will no longer be enforced in the same manner it has been over the past 2 years. The public charge rule allowed discretionary denial of green cards if the applicant was deemed as an economic burden on the country. Trump era public charge rule expanded the types and amount of government assistance that would disqualify green card applicants.
Secretary of Homeland Security Alejandro N. Mayorkas. Stated that ““The 2019 public charge rule was not in keeping with our nation’s values. It penalized those who access health benefits and other government services available to them.” The 2019 public charge rule was already facing a bevy of legal challenges in the court system.
The Department of Homeland Security (DHS) further explained that the public charge rule, which has been around since the 1880’s, will revert to Clinton-era determinations. Then 1999 public charge rule greatly limits the type of benefits that will flag the applicant as a potential public charge.
