USCIS Implements New H-1B Registration Process Starting 2020
On December 6, 2019, USCIS announced that the new H-1B registration process will be active for the fiscal year of 2021. Specifically, the initial registration period will begin on March 1, 2020 and end on March 20, 2020. USCIS reserves the possibility of prolonging this registration period or even opening up a second registration period if the H-1B quota is not met during the initial registration period. Employers will be required to pay a small $10 fee to register each individual. The registration process will require basic information about the company and each requested worker. Step by step instructions along with key dates and timelines will be released by USCIS at a later date.
Under this new process, employers will first sign up to an online registration system where they will have to register each forthcoming H-1B candidate. USCIS will then conduct the lottery and notify the employers on whether any of their petitions were selected. The employers will then have a time period to submit their selected H-1B petitions along with any supporting evidence and documents. In essence, “prospective petitioners with selected registrations will be eligible to file a cap-subject petition only for the alien named in the registration”.This is dramatically different from the previous process where the petition is submitted first, and the lottery selection occurs afterwards. This new registration process seeks to streamline the H-1B application process.
