September 2019 Visa Bulletin: China EB-2 Remains Unchanged

The U.S. Department of State (DOS) has published the latest visa bulletin for September 2019.  Notably, cut-off dates for petitioners from all other countries and regions in EB-1 except China-Mainland and India advance in September.
                                                                                 
Final action dates for employment-based preference petitions are as follows:

  • The EB-1 category is still no longer current for any foreign national. For mainland-Chinese petitioners, the cut-off date has retrogressed from July 1, 2016 to January 1, 2014. For Indian petitioners, the cut-off date has retrogressed from January 1, 2015 to unauthorized. For petitioners from all other countries and regions, the cut-off dates have advanced from July 1, 2016 to October 1, 2017
  • In the EB-2 category, the cut-off date for nationals born in mainland China remains on January 1, 2017. The cut-off date for Indian nationals has advanced from May 2, 2009 to May 8, 2009. For petitioners from all other countries and regions, the cut-off dates have advanced from January 1, 2017 to January 1, 2018
  • In the EB-3 category, the cut-off date for China-mainland has retrogressed from July 1, 2016 to January 1, 2014. The cut-off date for Indian nationals has retrogressed from January 1, 2006 to July 1, 2005. For petitioners from all other countries and regions, the cut-off dates remain on July 1, 2016.
  • In the EB-5 category, the cut-off date for nationals from mainland China has advanced from October 15, 2014 to October 22, 2014. EB-5 visa numbers are available to all nationals, aside from applicants from mainland China, Vietnam (cut-off date has advanced from October 15, 2014 to October 22, 2014) and India (cut-off date has advanced from October 15, 2014 to September 1, 2017). 

Filing dates for employment-based preference petitions are as follows:

  • The EB-1 category is still no longer current for any foreign national. For mainland-Chinese and Indian petitioners, the cut-off dates remain on October 1, 2017. For petitioners from all other countries and regions, the cut-off dates remain on September 1, 2018
  • In the EB-2 category, the cut-off date for nationals born in mainland China has advanced from February 1, 2017 to June 1, 2017. The cut-off date for Indian nationals remains on June 1, 2009.
  • In the EB-3 category, the cut-off date for China-mainland remain on June 1, 2016. The cut-off date for Indian nationals remains on April 1, 2010.
  • In the EB-5 category, the cut-off date for nationals born in mainland China has advanced from November 15, 2014 to November 22, 2014
