February 2019 Visa Bulletin: Employment-Based Categories Progresses Slightly

The U.S. Department of State (DOS) has published the latest visa bulletin for February 2019.  Notably, cut-off dates for most employment-based visa categories progresses slightly in February.
                                                                                 
Final action dates for employment-based preference petitions are as follows:

  • The EB-1 category is still no longer current for any foreign national. For mainland-Chinese and Indian petitioners, the cut-off dates have advanced from December 15, 2016 to February 8, 2017. For petitioners from all other countries and regions, the cut-off dates have advanced from October 1, 2017 to December 1, 2017. 
  • In the EB-2 category, which becomes current worldwide except China-Mainland and India, the cut-off date for nationals born in mainland China has advanced from August 1, 2015 to October 1, 2015. The cut-off date for Indian nationals has advanced from April 1, 2009 to April 6, 2009.
  • In the EB-3 category, which becomes current worldwide except China-Mainland, India and Philippines, the cut-off date for China-mainland has advanced from June 8, 2015 to July 1, 2015. The cut-off date for Indian nationals has advanced from March 1, 2009 to April 22, 2009.
  • In the EB-5 category(Non-regional center), the cut-off date for nationals from mainland China remains on September 1, 2014. EB-5 (Non-regional center) visa numbers are available to all nationals, aside from applicants from mainland China and Vietnam (cut-off date advances from June 1, 2016 to June 15, 2016). 

Filing dates for employment-based preference petitions are as follows:

  • The EB-1 category is no longer current for any foreign national. For mainland-Chinese and Indian petitioners, the cut-off dates remainon October 1, 2017. For petitioners from all other countries and regions, the cut-off dates remain on June 1, 2018. 
  • In the EB-2 category, the cut-off date for nationals born in mainland China has advanced from September 8, 2015 to November 1, 2015. The cut-off date for Indian nationals remains on May 22, 2009.
  • In the EB-3 category, the cut-off date for China-mainland remains on January 1, 2016. The cut-off date for Indian nationals remains on April 1, 2010.
  • In the EB-5 category, the cut-off date for nationals born in mainland China is likewise unchanged, remaining on October 1, 2014.
