October 2018 Visa Bulletin: Significant Progress as Fiscal Year 2019 Begins

The U.S. Department of State (DOS) has published the latest visa bulletin. Notably, with fiscal year 2019beginning next month, cut-off dates for most employment-based visa categories are slated to advance in October.
                                                                                 
Final action dates for employment-based preference petitions are as follows:

  • The EB-1 category is still no longer current for any foreign national. For mainland-Chinese and Indian petitioners, the cut-off dates have advanced from January 1, 2012to June 1, 2016. For petitioners from all other countries and regions, the cut-off dates have advanced from June 1, 2016 to April 1, 2017
  • In the EB-2 category, which becomes current worldwide except China-Mainland and India, the cut-off date for nationals born in mainland China has advanced from January 1, 2013 to April 1, 2015. The cut-off date for Indian nationals has advanced by the same amount of time: from January 1, 2007 last month to March 26, 2009.
  • In the EB-3 category, which becomes current worldwide except China-Mainland, India and Philippines, the cut-off date for China-mainland has advanced from November 1, 2014 to June 1, 2015, this month. The cut-off date for Indian nationals has advanced by six years: from January 1, 2003 to January 1, 2009.
  • In the EB-5 category(Non-Regional Center), the cut-off date for nationals from mainland China has advanced from August 8, 2014 to August 15, 2014. EB-5 (Non-Regional Center) visa numbers are available to all nationals, aside from applicants from China and Vietnam. EB-5 (Regional Center) visa numbers are unavailable to all nationals worldwide.

Filing dates for employment-based preference petitions are as follows:

  • The EB-1 category is no longer current for any foreign national. For mainland-Chinese and Indian petitioners, the cut-off dates are October 1, 2017. For petitioners from all other countries and regions, the cut-off dates are June 1, 2018
  • In the EB-2 category, the cut-off date for nationals born in mainland China has advanced from April 1, 2015 to June 15, 2015. The cut-off date for Indian nationals has advanced from March 26, 2009to May 22, 2009.
  • In the EB-3 category, the cut-off date for China-mainland has advanced from January 1, 2016 to August 8, 2015. The cut-off date for Indian nationals has advanced fromMay 1, 2009 to October 1, 2009.
  • In the EB-5 category, the cut-off date for nationals born in mainland China is likewise unchanged, remaining at October 1, 2014
