The U.S. Department of State (DOS) has published the visa bulletin for September 2017. Cut-off dates remain unchanged for all EB-1 categories, while EB-2 and EB-3 nationals will benefit from modest advancement in cut-off dates this month.
                                                                                                              
Final action dates for employment-based preference petitions are as follows:

• The EB-1 category is current for all nationals, excluding those born in mainland China and India; the cut-off date for both groups is still January 1, 2012.
• In the EB-2 category, the cut-off date for nationals born in mainland China has moved up three weeks, from April 22, 2013, last month to May 15, 2013, this month. The cut-off date for Indian nationals has advanced one month: August 22, 2008. The final action date for all other nationals is currently January 1, 2016.
• In the EB-3 category, the cut-off date for China-mainland nationals remains January 1, 2012. The cut-off date for Indian nationals has advanced three months, from July 15, 2006, last month to October 15, 2006, this month.
• In the EB-5 category, the cut-off date for China-mainland applicants is unchanged: June 15, 2014. EB-5 visa numbers are available to all other nationals.

Filing dates for employment-based preference petitions are as follows:

• The EB-1 category is current for all chargeability areas.
• In the EB-2 category, the cut-off date for China-mainland is unchanged from the visa bulletins for the last several months: October 1, 2013. The cut-off date for Indian nationals likewise remains the same: February 1, 2009.
• In the EB-3 category, there is no movement in the cut-off date for China-mainland nationals: September 1, 2015. For Indian nationals, the cut-off date also remains unchanged: January 1, 2007.
• In the EB-5 category, the cut-off date for nationals born in mainland China has not advanced since June, remaining September 1, 2014.

Our Advice

If you believe you qualify for a National Interest Waiver (NIW) but are not sure if you’re as strong a candidate for an EB-1, we recommend starting your NIW application as soon as possible. In general, we encourage our clients to file NIW applications (provided they meet the requirements).
