June 2017 Visa Bulletin: EB-1 Final Action Dates for China-mainland and Indian Nationals No Longer “Current”

The U.S. State Department has released the visa bulletin for June 2017. By and large, little has changed since last month’s bulletin, with the notable exception of the EB-1 category, for which the final action cut-off dates for China-mainland and Indian nationals are no longer current.

Final action dates for employment-based preference cases are:

  • The EB-1 category is current for all nationals, excluding those born in mainland China and India; the cut-off date for both groups is January 1, 2012.
  • In the EB-2 category, the cut-off date for nationals born in mainland China has moved up from February 8, 2013, last month to March 1, 2013, while the cut-off date for Indian nationals has moved up from June 22, 2008, to July 1, 2008. EB-2 visa numbers are available to all other nationals.
  • In the EB-3 category, the cut-off date for nationals born in mainland China has remained the same as last month: October 1, 2014. The cut-off date for Indian nationals has moved up from March 25, 2005, last month to May 15, 2005, this month.
  • In the EB-5 category, the cut-off date for nationals born in mainland China has moved up roughly two weeks from last month to June 8, 2014. EB-5 visa numbers are available to all other nationals.

Filing dates for employment-based visa applications are:

  • The EB-1 category is current for all nationals.
  • In the EB-2 category, the cut-off date for China-mainland has moved up to October 13, 2013, while the cut-off date for Indian nationals has not changed since last month: February 1, 2009.
  • In the EB-3 category, the cut-off dates for China-mainland and Indian nationals are unchanged since last month: September 1, 2015, and April 22, 2006, respectively.
  • In the EB-5 category, the cut-off date for nationals born in mainland China has also remained the same as last month’s cut-off date: September 1, 2014.

Our Advice

If you believe you qualify for an NIW but are not sure if you’re as strong an applicant for an EB-1, we recommend starting your NIW application as soon as possible.
