October 2016 Visa Bulletin

The Department of State released the latest visa bulletin for October2016 on September 9, 2016. 

According to application final action dates for employment-based reference cases,
for the month of October 2016, the EB-1 category is current for nationals all over the world.

In EB-2 category, the cut-off dates move forward from January 1, 2010 to February 15, 2012 for Chinese Mainland nationals while the cut-off dates move forward from February 22, 2005to January 15, 2007 for Indian nationals. The EB-2 visa numbers are available for applicants of all other countries and regions. In the EB-3 category, the cut-off dates move forward from January 1, 2010 to January 22, 2013 for Chinese Mainland nationals while the cut-off dates move forward from February 15, 2005 to March 1, 2005 for Indian nationals. For the EB-5 investment immigration (Non-Regional Center), the cut-off dates move forward from February 15, 2014 to February 22, 2014 for Chinese Mainland nationals. The EB-5 visa numbers are available for applicants of all other countries and regions except China-Mainland. 

According to dates for filing of employment-based visa applications, the EB-1 category is current for nationals all over the world. In EB-2 category, the cut-off dates retrogress from June 1, 2013 to March 1, 2013 for Chinese Mainland nationals while the cut-off dates retrogress from July 1, 2009 to April 22, 2009 for Indian nationals. In the EB-3 category, the cut-off dates retrogress from May 1, 2015 to May 1, 2014 for Chinese Mainland nationals while the cut-off dates remain unchanged on July 1, 2005 for Indian nationals. For the EB-5 investment immigration, the cut-off dates retrogress from May 1, 2015 to June 15, 2014 for Chinese Mainland nationals.

We recommend that you file your NIW petition as soon as possible if you are qualified for a NIW but not so good for an EB-1. In fact, we always encourage our clients to file a NIW petition if they are qualified. For the year of 2008, our firm received 402 NIW approvals. For the year of 2009, our firm received 430 NIW approvals. For the year of 2010, our firm received 223 NIW approvals. For the year of 2011, our firm received 286 NIW approvals. For the year of 2012, our firm received 351 NIW approvals and 245 EB-1 approvals. Forthe year of 2013, our firm received 357 NIW approvals and 216 EB-1 approvals. For the year of 2014, our firm received 203NIW approvals and 246 EB-1 approvals. From the year of 2015, our firm received 253NIW approvals and 187 EB-1 approvals. From January to June 2016, our firm received 162 NIW approvals and 108 EB-1 approvals. 

After NIW is approved, you may also apply for EB-1 if you get more and greater achievements.
