On April 13, 2016, USCIS announced that the random selection process for the 65,000 H-1B and 20,000 advanced degree caps has been completed. According to USCIS, over 236,000 H-1B cases were filed for FY 2017. This is a 3,000 application increase from the previous fiscal year which saw around 233,000 H-1b applications.
For those petitions not randomly selected in both categories, USCIS will reject and return the petition with their respective filing fees. USCIS will continue to accept and process petitions that are exempt from the cap, including the following: petitions to extend the amount of time an H-1B worker remains in the U.S, change the terms of employment for current H-1B workers, allow H-1B worker to change employers and allow current H-1B workers to work concurrently in a second H-1B position.
