H-1B Cap for FY 2017 Has Been Reached
The U.S Citizenship and Immigration Service announced on April 7th, 2016 that it has reached the cap of H-1B petitions for the fiscal year of 2017. This cap includes 65,000 H-1B’s as well as the 20,000 cap for U.S advanced degree exemption.This comes as no surprise as the cap has been quickly filled for the past few years and was predicted to be filled within 5 business days for FY 2017.
USCIS will randomly select petitions using a computer generated process to meet the 65,000 visas under the general category and the 20,000 visas under the advanced degree exemption. USCIS will first process the advanced degree exemption petitions. Those who are not selected will put into the lottery for the general 65,000 visas.For those petitions not randomly selected in both categories, USCIS will reject and return the petition with their respective filing fees.
USCIS will continue to accept and process petitions that are exempt from the cap, including the following: petitions to extend the amount of time an H-1B worker remains in the U.S, change the terms of employment for current H-1B workers, allow H-1B worker to change employers and allow current H-1B workers to work concurrently in a second H-1B position.
