H-1B Cap for 2016 FY Has Been Reached

On April 7, 2015 USCIS announced that the mandated H-1B cap for the 2016 fiscal year has been reached due to the large number of H-1b petitions. In addition, the U.S advanced degree exemption has also exceeded the 20,000 limit.

USCIS will randomly select petitions using a computer generated process to meet the 65,000 visas under the general category and the 20,000 visas under the advanced degree exemption. USCIS will first process the advanced degree exemption petitions. Those who are not selected will put into the lottery for the general 65,000 visas.

However due to the high number of petitions this year, USCIS will first complete the intake process before conducting the random selections. USCIS have not released when they will hold the lottery.

USCIS will continue to accept petitions exempt from the cap including petitions filed for current H-1b workers who have counted against the cap in previous years, petitions to extend the stay for H-1b workers, petitions to change terms of employment or employers, and petitions to allow current H-1b workers to work in a second H-1b position.
