Executive Actions' Effects on Timing of Filing for Adjustment of Status
On November 20th, 2014, President Obama announced a series of executive actions to reform immigration policy. According to AILA’s website, amongst the expected changes, one of them relates to address those with approved employment based petitions. To be more specific, “The ability of individuals with an approved employment-based immigrant petition who are caught in the quota backlogs to file for adjustment of status will be advanced to permit them to obtain the benefits of a pending adjustment. This is expected to impact about 410,000 people. This will be done by regulation.”
This change is greatly needed as there are a huge number of approved petitions in backlog. This will mainly benefit those from backlogged countries, such as India, China and Mexico, who have approved EB petitions. This has been an on-going problem. Many people would have to wait many years before they can receive their green cards. Further details on how this forthcoming change will be implemented are still unknown and may be cleared up in the upcoming months through regulations.
