The Department of State (DOS) has recently released statistics pertaining to the INA 212(e), waiver of the two year home country physical presence requirement. Out of a total of 6,717waiver recommendations filed in the fiscal year of 2014 (FY2014), 6579 was ruled as favorable while 138 as unfavorable.

In FY 2014, a vast majority of INA 212(e) waivers recommendations were under the no objection statement category. Out of the 5,068 no objection statement waiver basis, 4,951 were viewed as favorable while 117 were viewed at unfavorable. In addition, there have been 270 waivers filed under the exceptional hardship basis with 252 ruled as favorable and 18 ruled as unfavorable. There was only 57 total INA 212(e) waivers filed under the persecution bases and all 57 were viewed as favorable. Similarly, only 157 waivers were filed under the interested government agency- physician category with all 157 ruled as favorable. Furthermore, 131 waivers under the interested government agency – other were filed in FY2014. Out of those 131 waivers, only 3 were viewed as unfavorable and 128 were viewed as favorable. Moreover, there were a total of 1034 waivers under the state department of health category and all were ruled as favorable. Finally, out of the 1,791 INA 212(e) Advisory Opinions from FY 2013, 816 were subject and 925 were not subject.
