Zhang and Associates Successfully Help Establish another Regional Center Designation

In late September 2014, Zhang and Associates, P. C. received notice from USCIS of the approval of the designation of one of our client’s new regional centers. Filed in early April 2014, the regional center was approved in less than six months, shorter than the average 7.1 months processing time due to the lack of an RFE and the excellent work put into the case.

In November 2013, Zhang and Associates was retained to help establish a regional center for an unexperienced client in this field. Considering the client was unsure about how to proceed, Attorney Jerry Zhang suggested applying for a regional center using a hypothetic hotel construction project in a TEA area in Houston, TX. In addition, Attorneys Victor Bush and Flora Bao also worked on this case. During the preparation process, Attorneys Jerry Zhang, Victor Bush and Flora Bao had multiple internal meetings to discuss the issues and the documents for the client’s case.

Using the I-924 application for regional center designation, we have to prove the project will focus on a particular geographical area and create full time jobs through each investor. We were able to accomplish this by consulting with an economist and one business planer to improve on the business plans for the case and predict the economic impacts.

In addition to proving economic impacts, the I-924 application also include organizational documents such as certificate of filing, employment identification number, consent to action regarding the formation of the regional center, company regulation, description detailing key members of the regional center, articles of incorporation, investment agreements, escrow agreements, licenses and much more. Zhang and Associates carefully and diligently created and prepared these documents and filed them to USCIS in a timely fashion.

According to IIUSA, the Association to Invest in the USA, a national membership-based 501(c)(6) non-profit industry trade association for the EB-5 Regional Center Program, in the fiscal year of 2013, USCIS received 436 I-924 with 218 approvals and 32 denials. This is a dramatic change for 2012 FY where there were only 240 receipts, 35 approvals, and 63 denials. This upward trend of both approvals (up 500%) and approval rates (from 35.7% to 87.2%) shows that regional centers are becoming a popular and viable method of obtaining permanent residency.
