American Immigration Lawyer Association held EB-5 Conferences at Chicago from August 22 to August 23, 2014. Attorney Jerry Zhang, Attorney Owen Gu and Attorney Chingfei Kong from Zhang & Associates attended the meeting.

According to the visa bulletin published the Department of State several days ago for the Month of September, 2014, the EB-5 visa for Chinese were available. 

On Saturday morning, August 23, 2014, Charles Oppenhiem, Chief of Immigrant Visa Control & Reporting at the U.S. Department of State announced said at the conferences that the visa number for EB-5 will no longer be available in September, 2014 but still be available from October, 2014.

Moreover, Mr. Oppenheim said that he expects EB-5 visa availability for China-born investors to retrogress 2 years beginning next year around May 2015. Mr. Oppenhiem has stated that due to the huge increase of demand of EB-5 visas from China-born investors, he predicts that starting around May 2015, the cut-off date in the EB-5 category for Chinese investors will retrogress to around mid-2013.  If this occurs, only Chinese investors who have had their I-526 petition approved from before 2014 will be eligible to obtain visas.  All other petitioners will have to wait in until new numbers as available. Mr. Oppenhiem also stated that once a cutoff date has been established, he predicts that a visa backlog will remain for quite some years.

Apparently, it is a bad news for Chinese EB-5 investors. Z&A will do a more detailed analysis and publish an article later.

Therefore, for many business people and extraordinary persons from China, the best alternative for these applicants are to apply for L-1, EB-1C and EB-1A.
