H-1B Cap for FY 2015 Has Been Reached

The U.S Citizenship and Immigration Service announced on April 7th, 2014 that it has reached the cap of H-1B petitions for the fiscal year of 2015 as they received about 172,500 H-1B petitions. This cap includes 65,000 H-1B’s as well as the 20,000 cap for U.S advanced degree exemption. This come as no surprise as the cap was filled on April 5th 2013 for FY 2014 and was predicted that the cap was going to be filled within 5 business days for FY 2015.

Because the cap has been reached within such a short period of time, USCIS held a random lottery to select 85,000 (20,000 of which is reserved for U.S advanced degree exemption) for H-1B visas on April 10th. USCIS took all the petitions received during the filing period, which ended on April 7th, and selected 85,000 H-1B (20,000 of which are for U.S advanced degree) through a random computer generated process. For those petitions not randomly selected, USCIS will reject and return the petition with their respective filing fees.

USCIS will continue to accept and process petitions that are exempt from the cap, including the following: petitions to extend the amount of time an H-1B worker remains in the U.S, change the terms of employment for current H-1B workers, allow H-1B worker to change employers and allow current H-1B workers to work concurrently in a second H-1B position.
