2011 年10月到12月，我们事务所有86个NIW案件获得批准，其中80个申请没有经过RFE就直接获得了批准。此外，在此期间，我们所还有46个EB-1申请顺利获得批准。整个2011年，我所共获得了286件NIW申请的批准， 206件EB-1申请的批准，815件I-485申请的批准以及269件H-1B申请的批准。
在过去3个月所批准的86个NIW案件中，大部分（占总人数近85%）申请者拥有博士学位。但是，其中10个申请者，或者说占总人数12%左右的申请者，只拥有硕士学位。但从数据分析中，我们发现这些硕士学位的成功大多从事比较冷门或比较前沿的研究，因此只要达到NIW的基本要求，加上足够优秀，将能相对顺利的获得批准。而那些在电子工程，医学和生物领域工作的申请者被迫与大量的申请者竞争。其结果是，移民局只能批准其中最强的。

那些拥有“博士后研究员”，“研究科学家”或其他类似职衔的人主要从事教学研究工作，撰写论文，以及参加会议。由于科学工作的性质，这一类申请者更容易通过客观证据显示他们已经拥有全国性的影响力，和易于通过更客观的证据（例如，引用，下载，成果商业化等等）保持过去成就的记录。当然，即使您觉得缺乏此类证据，也不要泄气。因为，每一个案件都是不同的，移民局能够认可您对美国有内在价值的独特资格和技能。就像以上所说明的，移民局不会仅根据具体数据来审核申请。我们事务所的经验丰富的律师将帮助您突出您最强的专业才能，同时淡化您较弱的部分。
另外，我们还从这些案例中总结了其它相关数据。在这些被批准的案例中，许多人从事工程、医学、和生物等领域的研究，也有一部分申请者从事物理、半导体等领域的研究工作。在这些申请者中，平均发表论文数量是11篇，平均引用次数是72次，引用次数的中间值是36次。申请的平均处理时间是187天或6个多月。批准案件最长的处理时间是503天，最短是15天。

我所上一季度获批的NIW申请的平均处理时间是229天或7个多月。批准案件最长的处理时间是406天，最短是37天。
对于出生在中国大陆的NIW EB-2申请人来说，需要等待较长时间的排期才能递交身份调整申请。不过请注意，如果您的配偶出生在除中国大陆或印度以外的其他国家或地区（包括港澳台三地），您在递交NIW申请时，可借用配偶出生所在地的移民名额，同时递交I-485申请，无需再等待排期。
此外，如果您在NIW批准后出了更大更重要的成果，也可以考虑申请EB-1。EB-1类别目前有签证名额可用，无需等待排期。不过，EB-1的审理也有变难的趋势，尤其是美国移民局在2010年8月18日出台了一个备忘录之后。从本质上说，该备忘录将EB-1评估过程分为两部分：1）评估申请者是否符合移民申请类别的标准底线，以及2）决定申请者的证据是否证明申请者达到了移民类别所要求的高水平专业资格。在第2部分审核程序中，移民局将评估全部证据，从整体上看是否能够证明申请者在其领域内是最顶尖的。
通俗来说，对于第一步审核，移民局官员着重看申请人在单纯的“量”上是否符合要求，在第二步审核中，移民局官员着重看申请人在总体的“质”上是否符合要求，“量”符合要求了不一定意味着“质”符合要求。
