Foreign Nurse Immigration petitions fall into the employment-based immigration third preference category. Normally, to file an employment-based third preference petition, Labor Certification approval is required. However, employers who wish to employa foreign registered nurse are exempt from having to submit an application for alien labor certification to the Department of Labor (DOL) or the State Employment Security Agency(SESA).
