USCIS released the latest H-1B visa information on August 16, 2011. As of August 12, 2011, USCIS reported that 25,300 cap petitions had been filed and 14,700 spots for U.S. advanced degree holders have been filled.

According to USCIS, as of July 29, 2011, 22,700 cap petitions had been filed and 13,800 spots for U.S. advanced degree holders have been filled.

In Summary, from July 29 to August 12, about 2600 cap petitions and 900 petitions for U.S. advanced degree holders have been filed.

As many spots are still not filled, we predict that H-1B availability will least likely cease sometime in next several months at the current pace.

In addition, on August 2, 2011, USCIS announced and outlined a series of policy, operational, and outreach efforts to promote the US economy and investment by attracting foreign entrepreneurial talent of exceptional ability or someone who can create jobs, form startup companies, and invest capital in areas of high unemployment. According to that announcement, USCIS has updated the FAQs to clarify an H-1B beneficiary who is the sole owner of the petitioning company may establish a valid employer-employee relationship for the purposes of qualifying for an H-1B non-immigrant visa. In other words, a sole owner of a company may apply for H-1B visa for him/herself. We think it good news for those foreign nationals who consider setting up companies themselves in the U.S.

However, please remember, those who receive a job offer from a U.S. University, governmental research institution or non-profit research organization will not count towards the general H-1B cap mentioned above.
