Friday, July 8th, we received some case transfer notices by email for cases of ours which were pending at the Texas Service Center. Some I-140 (Eb-1A, EB-1B and NIW) and I-485 cases were being transferred to the Nebraska Service Center from Texas Service Center. This is most likely due to the fact that the Texas Service Center has been behind on its I-140 processing time goals, exceeding the target of 4 months for processing, whereas Nebraska is steadily holding to the 4 month processing time goal. Currently, cases are being processed at the Texas Service Center have been taking from 8 to 10 months to be adjudicated, which is at least double the processing time goal. The Texas Service Center has likely seen an increased volume of petitions and applications which is leading to the delays, and USCIS seems to be attempting to alleviate the strain on the Texas Service Center by transferring cases to Nebraska.
With the current situation, it is prudent to consider using premium processing if it is an option available to an I-140 classification you are filing. Currently premium processing is available for EB-1A and EB-1B cases. Premium processing guarantees a decision on your case (or a RFE) in 15 days or you receive your premium processing fee back. By using premium processing, you will avoid having your case transferred as well as be assured you will hear quickly about the result of your case. However, if your case is not very strong, a RFE is likely to be issued. You are only given 30 days to respond the RFE.
