Automatic Visa Revalidation after a trip to US’s Neighboring Countries and Adjacent Islands
A foreign national who has a valid non-immigrant status can usually revalidate his/her expired visa automatically when returning from a visit of 30 days or less to Canada, Mexico, or one of the islands adjacent to the United States (other than Cuba). This process is known as automatic visa revalidation. (22 CFR 41.112 (d))
It is applicable to F-1, F-2, H-1B, H-4 and other non-immigration visa holders. An F-1 visa holder needs a valid SEVIS Form I-20 and a valid unexpired Form I-94 while an H-1B visa holder needs a valid passport, I-94, and H-1B approval notice. In other words, sucha foreign national does not need to apply for a visa to come back to the US if he/she returns to the US within 30 days of visit to those regions.
The term "adjacent islands" includes Saint Pierre, Miquelon, Cuba, the Dominican Republic, Haiti, Bermuda, the Bahamas, Barbados, Jamaica, the Windward and Leeward Islands, Trinidad, Martinique, and other British, French, and Netherlands territory or possessions in or bordering on the Caribbean Sea. [Reference INA, Section 101(b)(5)]
