On April 8, USCIS announced it will continue to accept H-1B petitions for both US advance degree quota cases and non-US advance degree quota cases. This is a clear indication that USCIS has not received enough applications to cover the 65,000 regular (non-US advance degree) H-1B quota and 20,000 US advance degree quota. It is therefore our conclusion that both types of H-1B quota cases filed with USCIS between April 1 and April 7, will receive quota spots provided the other H-1B filing requirements are met.
USCIS’ announcement stated that it would continue to track H-1B filings to monitor quota usage and would announce the “last date of receipt for quota” when quota is met. This announcement may come later than the actual “last date of receipt.” For example, USCIS may announce on April 25 that the “last date of receipt” for regular quota was April 20. If this is the case, regular quota cases arriving at USCIS after April 20 will be rejected, and cases received on April 20 will be subject to the lottery.
