DOS Predicts EB-2 Cut-off Dates Leap forward in May for Indians and Chinese
According to a message posted by AILA on March 29, 2011, Charlie Oppenheim, Chief of Immigrant Visa Control and Reporting Division, U.S. Department of State, informed AILA of a dramatic reduction in the use of EB-1 numbers. He stated that the decline in EB-1 number use would allow him
to begin having those ‘otherwise unused’ numbers drop down and be available for use in the EB-2 category. Based on current indications, that would mean that at least 12,000 additional numbers will be available to the EB-2 category. It will benefit Indian EB-2 applicants most as the demand
in India has had the largest concentration of early dates.
The EB-2 category includes NIW and EB-2 under PERM. According to our experience, PERM cases have been processed very quickly since the second half of last year. Most of our PERM cases have been getting approvals within a few weeks. On January 28, we had one PERM case approved in just two days after the case submission. We think now a good time for applicants who wish to get green card through PERM to take advantage of this situation.
Even though Chinese and Indian NIW applicants cannot concurrently file NIW and I-485 because EB-2 visa numbers are not current, a person can file an NIW first to get an early priority date. Later if he/she improves his/her credentials, he/she can file EB-1.
