Registration Requirement for H-1B Petitions and Latest H-1B Count

USCIS recently published a proposed rule to establish a mandatory, internet-based, electronic registration process for U.S. employers seeking to file H-1B petitions for workers that are subject to either the 65,000 or 20,000 annual numerical limitations.

According to USCIS, this rule will reduce costs for some employers and increase them for others. For employers that are not allocated a cap number and therefore do not ultimately file a petition, there will be a significant cost savings. Employers that are allocated a cap number and ultimately file a petition will experience the new and additional cost of filing the registration.

This rule may become effective after a comment period of two months. In addition, USCIS released the latest H-1B visa information on January 4, 2011. As of December 31, 2010, USCIS reported that 57,300 cap petitions had been filed and 20,000 spots for U.S. advanced degree holders have been filled. While USCIS has now received over 20,000 petitions filed on behalf of individuals who have earned a Master’s degree or higher from a U.S. institution of higher education, USCIS continues to accept these petitions and they will be counted against the regular cap until the regular cap is reached.

However, please remember, those who receive a job offer from a governmental or non-profit organization will not count towards the general H-1B cap mentioned above and will not need to meet the new registration requirement.
