Immigration What kind of Supporting Documents are Needed for the petition?

The documents needed for spouse the immigration petition (Form I-130) are as follows:

  • Copy of the U.S. permanent resident's green card;
  • Marriage certificate between the alien spouse and the U.S. permanent resident;
  • Divorce decrees showing termination of all prior marriages of the alien spouse and the U.S. permanent resident; and
  • Two recent color photos of the U.S. permanent resident and two recent color photos of the alien spouse.

The documents needed for child the immigration petition (Form I-130) are as follows:

  • Copy of the U.S. permanent resident's green card;
  • The child's birth certificate showing the name of both parents.
  • Two recent color photos of the U.S. permanent resident and two recent color photos of the alien child.

The documents needed for spouse's adjustment of status application (Form I-485) are as follows:

  • Two recent identical color photos of the alien spouse;
  • Medical exam report I-693 and supplement of the alien spouse (sealed);
  • Evidence of financial condition of the alien spouse if he or she has a job:
    --- The alien's employment verification letter on business letterhead;
    --- The alien's W-2 forms for past three years;
  • Evidence of financial support for the alien spouse:
    --- The sponsor's employment verification letter on business letterhead;
    --- The sponsor's W-2 forms for past three years;
  • Copy of the alien spouse's passport, visas, and I-94;
  • Documents showing alien spouse's legal status after coming to the U.S., such as the alien spouse's I-797, I-20, IAP-66; and
  • Marriage certificate.

The documents needed for child's adjustment of status application (Form I-485) are as follows:

  • Two recent identical color photos of the alien child;
  • Medical exam report I-693 and supplement of the alien child (sealed);
  • Evidence of financial support for the child:
    --- The sponsor's employment verification letter on business letterhead;
    --- The sponsor's W-2 forms for past three years;
  • Copy of the alien child's passport, visas, and I-94;
  • Documents showing alien child's legal status after coming to the U.S., such as the alien child's I-797, I-20, IAP-66; and
  • Birth certificate.
